課程概述

1. COURSE DESCRIPTION
The goal of this course is to introduce the basic concepts of criminal law, and the common structure constituting every offense. They include:
Actus Reus (the threshold of criminal culpability, the rationale for punishing attempt, the relationship between attempt and accomplished offense, the elements of attempt, the “defense” of impossibility, withdrawal and abandonment); Criminal Responsibility (the concept of expectation, the capability for criminal responsibility, unlawful consciousness, the broad sense of criminal responsibility); Complicity (the concept of offenders, principals, the attempt and accomplishment of complicity, aiders and abettors, complicity and the requirement of identity); Failure to Act (the concept of failure to act, the basic issues of failure to act, the elements of failure to act, failure to act and attempt, failure to act and complicity); Concurrence (introduction to the issues in concurrence, the basic principles of concurrence, statute concurrence, imaginary concurrence, the punishment of multiple offenses)

2. REQUIRED TEXTS
Basic Criminal Law written by Professor Huang Jung-Chien, and textbooks by other Criminal Law professors, such as Professors Han Chung-Mo and Lin Shan-Tian.

3. EVALUATION
Grades will be based on the result of the final exam. Students will be evaluated based on their capacities of analyzing cases and reasoning, instead of their abilities to memorize relevant theories.

4. QUALIFICATION IN THE CLASS REGISTRATION
This course is open only to the students who have passed the course “Criminal Code- General Principles(1)” offered by me.
